ELIGIBILITY
To purchase a raffle entry, you must be a licensed driver, 21 years or older, and a resident of the United States (except Puerto Rico).  The raffle is subject to all federal, state and local laws and regulations, and is void wherever prohibited by law.  Entries may be purchased via mail or at the Tender Loving Care Foundation (“TLC”) Event to be held on June 2, 2007 (the “Event”).  It is the purchaser's responsibility to include on the raffle entry purchase form a valid, deliverable mailing address and phone number.  TLC assumes no responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible, or undelivered entries, or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified.  Certain states deem raffles illegal -- entry purchasers must determine if they are in compliance.  By entering the raffle, the entry purchaser acknowledges that he or she is aware of and agrees with the raffle official rules.  All purchases of raffle entries are non-refundable and non-transferable.  TLC reserves the right not to accept entries at its discretion.

DRAWING
There is no maximum number of raffle entries that will be sold.  Odds of winning are determined by the number of eligible entries received.  The winner will be selected in a random drawing to be conducted at the Event.  To be eligible, an entry must be received before such drawing.  You need not be present at the drawing to win.  If fewer than 750 raffle entries are sold, TLC reserves the right to award the winner 1/2 of the raffle entry sale net proceeds, not to exceed $50,000.  If 750 or more raffle entries are sold, the winner may choose either the car or a cash prize equal to $50,000, and must notify TLC of its choice on or before August 15, 2007.

PRIZE
If the winning entry has more than one name, TLC will award the prize to the first name listed on the entry.  Records of TLC shall be deemed correct if there is any discrepancy.  TLC is not responsible for resolving any disputes that may arise from different individuals listed on a raffle entry.  The car is awarded AS-IS with no warranties or guarantees expressed or implied.  All applicable taxes (Federal and State) and/or fees must be paid prior to delivery.  The winner is solely responsible for any and all federal, state or local license, title, registration, taxes, fees, assessments, and like charges associated with the vehicle, as well as insurance (proof of which must be shown prior to possession) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership.  The vehicle may not be exactly as shown in the raffle offering, is subject to availability at the automobile dealer shown in the raffle offering, and may be substituted with a vehicle of comparable value by TLC.  

NOTIFICATION OF WINNERS
The winner will be announced at the Event and will be notified in writing or by phone.  If the winner does not redeem his prize on or before August 15, 2007, or is unable to be contacted on or before such date, the prize or its cash equivalent will be deemed to have been donated to TLC.  All contact attempts shall be made to the address and phone number listed on the raffle entry form.  By entering, the winner authorizes TLC to publish and use his name, photograph or other likeness on the TLC website and in other promotional materials by TLC.

TAXES AND IRS RULES
All applicable taxes (Federal and State) and/or fees must be paid prior to delivery. If a cash prize is chosen, it shall be paid net of applicable income tax withholding. TLC will comply with the withholding rules in effect at the time the prizes are awarded.

WAIVER/LIMITATIONS OF LIABILITY
Entry purchasers, by participating (and the winner, by accepting the prize) release TLC and its board members, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize awarded, and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality, mechanical condition or fitness.  Any liability of TLC shall be limited to the raffle entry price paid.  TLC reserves the right to modify or amend these Rules without notice at any time prior to the drawing.

The Tender Loving Care Foundation is a New York State not-for-profit corporation recognized as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code.
